Grant Of Probate

If the deceased had a valid will made before their passing, the executor named in the will can apply for a Grant of Probate to handle the estate.

If the deceased did not leave a will or if the will is invalid, the direct relatives of the deceased must apply to the court for a Letter of Administration to manage the estate.


Documents Required for Applying for a Grant of Probate:

To apply for a Grant of Probate, the following documents are required:

  • The Will
  • Death Certificate
  • Beneficiaries’ Identity Cards
  • Asset Documents (e.g., property deeds, sale and purchase agreements, land tax receipts, assessment bills, vehicle registration, etc.)

The Process of Applying for a Grant of Probate:

Applying for a Grant of Probate is not a simple process and involves handling a lot of documentation. It is recommended that you hire a lawyer who is familiar with the procedure to assist you with the application.

If there is a dispute during the application for Probate or Letter of Administration, or if there are concerns about the validity of the will, direct relatives or interested parties can apply to the court for a Caveat. It is advisable to seek legal advice from a lawyer experienced in this process.
